Q&A: Proof of Divorce and Bigamy Charges in Texas?
Question by angelsbreath: I am the second of three wives. My husband is a bigamist. I am filing a petition to declare my marriage void in Texas. However, when I go to court, I need to provide proof to the judge that my husband never divorced his first wife. Since there is not a national database for marriages and divorces, how can I go about finding proof? I am almost certain that
he did not divorce her, in fact, he told me that he didn’t. However, I know that my word isn’t going to stand up in a court of law. I have already searched for record of a divorce in Texas, Oklahoma and Arkansas and can find no record in these states. Also, does anyone know how to go about filing bigamy charges in Texas?

You need to take the proof of your search to your local police station and file a police report.
You will make a signed complaint which is your word, and will be valid in a court of law.
The detective investigating will take the search over from there, and be able to check data bases that you don’t have access to.
If he’s being charged with bigamy, it should be up to him to provide the necessary documentation that he was divorced prior to marrying you.
If he’s not…..then trot on down to your local police station and file a complaint.
I’m sad to hear this is your situation. I had something similar but in my case the jerk actually cared enough to forge his ex’s name to their divorce so technically mine *did* get a divorce but she & I know it’s a doctored up crock of poopoo so oh well…I got my own very REAL divorce anyway.
I read up on this website : fightbigamy.typepad.com, all I could about my state law and how others got assistance. Proof is VERY hard to come by in this. You could though, ask your divorce attorney to demand a copy of that divorce (since it is in question).

There is nothing you can do.
unless you know the town or county of the state you can not find anything….but everything is public record…one good thing..in texas divorce is final in only 2 months…for a small fee the courthouse will usually make copies and mail. as for the bigamy charge in texas write a letter to the courthouse in the town or county and they can help…or you could call the district attorney for that area
