What’s the laws requiring infant drug testing at birth?

As far as I know a hospital can do it when the baby is born, without the mothers permission. The hosiptal did it to my daughter and I did not even know until they told me she tested negative for drugs.
The prevalence rate of drug use by pregnant women in the United States has been shown to range from 7.5 percent to 11 percent. Drug exposure in utero has been associated with deleterious effects on the fetus and newborn.
Public health officials are currently confronted with difficult policy decisions with regard to testing and reporting of pregnant and post-partum women and the provision of appropriate services.
The widespread lack of consistent policy on the State level has led to bias in testing and reporting procedures and to the inappropriate use of the legal system as a deterrent to drug use during pregnancy. A survey of the 50 States and the District of Columbia found that no State currently has enacted legislation regarding testing. Thirteen States have mandatory reporting policies for drug-exposed newborns. Eleven of these States require reporting to social service agencies, at least 3 States routinely report to criminal justice agencies, and 10 require that reports be filed as child abuse or neglect.
Many States without mandatory reporting statutes indicate that reports are made to social service agencies at the discretion of the health care provider.
Depends on the state and county. The county in Ohio I use to live in wouldn’t test unless there was a court order or the mother came in obviously high but I know of one county in ohio that has a law in effect that they do a drug test on every newborn. Where i live now there is no law stating specifics but if it is suspected that the baby is in drug withdrawl after birth or if the mother is obviously on some kind of drug when she comes in or if there is a court order for whatever reason then they will run the drug test.
Most delivering hospitals will do it if they suspect the mother is under influence at the time of admission, has a prenatal history of confirmed drug use or if the mother freely admits to a history. If the baby is having symptoms of drug abuse they will do it as well. Many hospitals do not give you results unless the screen is positive but each state is different on policies. They will most likely do one on mom as well to compare and confirm. As far as the official law there is a fine line on what is legal and what is done without consent.

its usually standard in most hospitals.
unusual question but if the person is a drug taker it will be pretty obvious when the infant is born with how the baby behaves.
so no avoiding it really
